What is a Environmental Legal Due Diligence?

Environmental Legal Due Diligence is a focused investigation of an organisation's environmental legal and regulatory compliance status — examining the validity and conditions of environmental consents, the status of Environmental Clearance conditions, compliance with pollution control standards, waste management authorisations, groundwater permissions, and any outstanding environmental enforcement actions or liabilities. The assessment identifies environmental legal risks that could affect the value, operability, or regulatory standing of a business or asset — including non-compliances that could result in consent cancellation, directions for closure, or financial penalties, as well as environmental liabilities such as contaminated land or historical pollution that could result in clean-up costs or third-party claims.

It is a standard component of investment and acquisition due diligence for industrial and infrastructure assets — and is increasingly required by development finance institutions, private equity funds, and multinational investors as part of their environmental and social risk management frameworks.
